Terms & Conditions
- In making a booking and paying the booking fee to Nelson Sailing Adventures Ltd the Hirer agrees to be bound by the complete terms and conditions of Nelson Sailing Adventures Ltd.
- Payment. A booking fee of 30% is required to confirm a booking. All enquiries are unreserved until the booking fee has been paid and confirmation advised unless otherwise agreed to. Balance of Charter fee is to be paid in full 10 working days prior to commencement of charter. Failure to pay balance by due date may result in cancellation of booking and forfeit of booking fee.
- Cancellation by Hirer. Full refund of Charter fee paid will be given provided notice of cancellation is received no later than 48hrs prior to booked charter commencement. 50% refund of Charter fee paid will be given if notice of cancellation is received between 24hrs & 48hrs prior to booked charter commencement. No refund will be given if notice of cancellation is received less than 24hrs prior to booked charter commencement. Gift vouchers are not redeemable for cash. Where a catering fee has been paid, ownership of catering provisions will remain with the Hirer and can be picked up from Nelson Sailing Adventures Ltd nominated location.
- Cancellation or Alteration by Nelson Sailing Adventures Ltd. Nelson Sailing Adventures Ltd reserves the right to cancel, reschedule or modify any confirmed booking at any time. Cancellations made by Nelson Sailing Adventures Ltd up to the time of scheduled charter departure, will at the Hirers discretion, be rescheduled or refunded. If Nelson Sailing Adventures Ltd shortens the scheduled charter; any Whole Days of scheduled charter not used will be refunded (except where cause of shortening is due to misconduct by the Hirer, in which case no refund will be made). If the intended route of the scheduled charter is changed by Nelson Sailing Adventures Ltd no refund of charter fee will be made.
- Refunds & Transfer of Fees Paid. Refunds will be made generally as allowed for in the various sections of these Terms & Conditions. The booking fee can be transferred to an alternative booking by the Hirer if notice of cancellation is received by Nelson Sailing Adventures Ltd no later than 48hrs prior to booked charter commencement. All Charter fees valid for refund can be transferred to an alternative Charter without incurring further costs.
- Correspondence. All correspondence shall be via mail or email, and be addressed to Nelson Sailing Adventures Ltd postal address or email address.
- Authority Whilst under charter. Absolute authority for the vessel and passengers/crew is with the Nelson Sailing Adventures Ltd Skipper. Nelson Sailing Adventures Ltd reserves the right to cancel, shorten and/or modify in any way, any charter if they perceive there exists an unacceptable risk to the safety of passengers/crew and/or vessel for whatever reason. Nelson Sailing Adventures Ltd Skipper's decision is final.
- Definition of Times. Scheduled charters will nominally commence at 0800hrs on the first day of scheduled charter and nominally finish at 1700hrs on the last day of scheduled charter unless confirmed otherwise by Nelson Sailing Adventures Ltd in writing. Unless on the first day and/or last day of scheduled charter, a Whole Day will be considered the 24hr period starting from 08.00hrs
- Liability Wavier. The Hirer acknowledges that travelling on the sea has inherent hazards and risks. The Hirer will not hold Nelson Sailing Adventures Ltd or any of its employees or agents liable for any event or situation before, during or after the Hirer's scheduled charter. As part of any normal holiday activity, Nelson Sailing Adventures Ltd recommends the Hirer take out their own travel insurance to provide financial cover for unforeseen circumstances that may arise before or during the scheduled charter. All care will be taken by Nelson sailing Adventures Ltd when handling client's equipment and belongings but will take no responsibility. Under all circumstances the client is responsible for their personal equipment and belongings
- Safety. The skipper is responsible for all safety decisions. All skippers are commercially qualified and are Maritime New Zealand certified. They are certified First Aiders.
All vessels are Maritime New Zealand surveyed. They are externally audited to ensure systems and operating procedures are of highest standards. There is a documented maintenance program and all gear is maintained regularly.
Clients must inform Nelson Sailing Adventures Ltd of any pre-existing medical conditions prior to trip departure.
